Training and conflict resolution: mediation and negotiation

Training and conflict resolution: mediation and negotiation

Aleksander Jakobčič is a lawyer specialised in peaceful dispute resolution (negotiation, mediation and arbitration) and an expert in the field of international relations and diplomacy, who has studied at various professional and academic institutions in Europe (London School of Economics and Political Science – LSE and University of London – Law, etc.). In addition to his 17 years of experience in international business, he has successfully resolved more than 200 mediations in international commercial and civil disputes as well as cross-border disputes. He has facilitated and represented clients in over 170 international negotiations in the EU, UK, Russia, Western Balkans, Kazakhstan, Georgia and Turkey. He is also the President of the Slovenian Mediators Association, a member of the Expert Council for Alternative Dispute Resolution at the Ministry of Justice of the Republic of Slovenia and a selected external mediator and negotiator for some major companies and organisations.

Mediation enables a peaceful, fast, economical and professional resolution of disputes, which is particularly important in business. At the heart of mediation are the principles of confidentiality, voluntariness and neutrality, among others, which bind both the mediator and the parties to the proceedings. In more complex proceedings, mediation also includes preconditions in which we agree on the language to be used and the law regarding the conduct of the mediation meetings and the conclusion of the mediation (depending on the dispute). Mediation is useful as a professional process for the peaceful settlement of disputes when we want to maintain control over the resolution of our dispute, when there is a breakdown in negotiations or when there is a major conflict between the parties.

Negotiation is a structured process that requires a lot of knowledge, skill and experience on the part of the negotiator, as well as some life wisdom. As a result, it is crucial to be represented by a good negotiator who understands the interests of the parties involved and takes the time to prepare thoroughly for the process. However, such an experienced negotiator can also ensure that the negotiations run smoothly and productively in the form of negotiation facilitation. This differs from mediation in that it does not follow the prescribed stages of the process, but is still a negotiation process. Professional management of the dispute and quality-led negotiation and mediation are of paramount importance, as failure to do so may even exacerbate the conflict.

Due to his extensive experience, Aleksander Jakobčič is often a sought-after lecturer and trainer of negotiators and mediators in international companies and other organisations. In his lectures and trainings, he combines both the latest theoretical and academic knowledge and extensive experience in the field of dispute resolution and negotiation. He has lectured to many negotiators, mediators and other professionals in Slovenia, the UK, Germany, Austria, Montenegro and Ukraine. The content of the lectures and training can be fully tailored to the wishes of the company or organisation and roughly includes: understanding conflict, relevant legal areas, the mediation process, the negotiation process, demonstration of practical examples, strategic communication skills, understanding the role of modern technologies (e.g. artificial intelligence), other factors and context, etc. The duration of the training and workshops is also tailored, ranging from 8 to 100 hours, and can be designed for both beginners and highly experienced negotiators and mediators. There is a strong emphasis on professionalism and ethics, from which Aleksander Jakobčič does not deviate in his practical work.
